These Terms constitute a legally binding agreement between you and Metrosure Insurance Brokers (Pty) Ltd (FSP No: 47089, Registration No: 2016/113504/07), a company registered in South Africa.

2. Description of Services

Metrosure Insurance Brokers provides insurance brokerage, financial advisory, and business-to-business sales and marketing services, including but not limited to:

Consumer Insurance Services: Short-term insurance (car, home, commercial) Life and funeral cover Retirement planning Employee benefits Investment advice Risk advisory services

B2B Partnership Services: In-Store Insurance Campaigns – Trained sales teams deployed at retail partner locations Device Leasing Programme – Cell phone and device financing at point of sale Call Centre Services – Lead generation, customer acquisition, and telemarketing Sales & Marketing Outsourcing – End-to-end sales division management for retail partners

Our insurance brokerage services are provided in accordance with our FSP licence (FSP 47089) and the Financial Advisory and Intermediary Services Act (FAIS). B2B partnership services are governed by separate commercial agreements with our retail partners.

5. B2B Partnership Terms

If you engage with Metrosure as a business partner for our B2B services (In-Store Campaigns, Device Leasing, Call Centre Services, or Sales & Marketing Outsourcing), the following additional terms apply:

Service Agreements: B2B services are governed by separate commercial agreements that specify scope, pricing, performance metrics, and service level agreements. These commercial agreements supplement these general Terms of Service.

Quality Assurance: We maintain a 95% quality assurance average across all sales operations. Our B2B services include dedicated quality assurance processes with regular monitoring and performance reporting.

Data Processing: When providing B2B services, we act as a data processor on behalf of our retail partners. Data handling is governed by formal data processing agreements in compliance with POPIA. Partners warrant they have lawful grounds to share customer data and have obtained necessary consents.

Performance Reporting: We provide regular performance reports and data-driven insights to our B2B partners as specified in the relevant service agreement.

Intellectual Property: Sales methodologies, training materials, QA frameworks, and proprietary processes shared by Metrosure remain our intellectual property. Partners may not reproduce or distribute these materials without prior written consent.

Limitation of Liability: Our aggregate liability under B2B agreements shall not exceed the fees paid by the partner in the twelve (12) months preceding any claim, unless otherwise specified in the commercial agreement.

6. Your Obligations

When using our Website and services, you agree to:

Limited Licence: We grant you a limited, non-exclusive, non-transferable licence to access and use this Website for personal, non-commercial purposes only.

8. Third-Party Links and Services

Our Website may contain links to third-party websites or services that are not owned or controlled by Metrosure. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

When we connect you with insurance products from our partners (such as Liberty, Sanlam, Discovery, Old Mutual, and others), those products are subject to the terms and conditions of the respective insurer.

9. Limitation of Liability

To the fullest extent permitted by South African law:

No Warranties: This Website is provided "as is" and "as available" without warranties of any kind, whether express or implied.

Limitation: Metrosure, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Website or services.

Maximum Liability: Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the fees paid by you to Metrosure in the twelve (12) months preceding the claim.

These limitations do not apply to liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Metrosure Insurance Brokers (Pty) Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

11. Termination

We may terminate or suspend your access to our Website and services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our Website and services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of South Africa, with the High Court of South Africa (KwaZulu-Natal Division, Durban) having preference.

13. Dispute Resolution

Complaints: If you have a complaint about our services, please contact us first. We will endeavour to resolve your complaint within 6 weeks.
